How might an online or blended classroom teacher use Fair Use when gathering resources for educational purposes? Teachers must consider four main factors when using copyrighted materials. First, what is the purpose? It should be educational and not commercial. Second, the amount of the material used should be a part, not whole. Making copies of an entire textbook is not fair use. Teachers can copy a page with several paragraphs or certain activities. Third, teachers must consider the effect of using the material. Fourth, teachers must consider the nature of the work.
What observations have you made about Fair Use and the TEACH Act and how has it changed your approach to finding reliable content for your students? Fair use applies to anyone while the TEACH Act applies specifically to educators. The latter is designed for accredited non-profit institution with a limited number of students. It can be for asynchronous or "live" classes.
