- How can one refrain from violating FERPA and TCPA guidelines in online communication? In order to protect students privacy, teachers should not provide information about grades or progress unless specified by administration. Information should only be given to parents and guardians. For TCPA teachers should not use automated dialing equipment without recipients permission.
- What methods could be employed to verify that copyright is not being violated? Use images from Public Domain or Creative Commons. Teachers and students must think about the following before using material: intent, nature of copyrighted work, amount of the section used and effect on target audience. The way the material is used should be transformative. Transformativeness occurs when a person does the following to copyrighted materials: value is added, repurposes for a different use, creates for different audience. Classroom Example - using a clip from a French music video to teach verb tenses and conjugation. Original purpose: entertainment and the nw purpose: instructional grammar lesson. The video was “transformed” because the new purpose was different than the old purpose. Also, the amount of the video used was small.
- Does copyright require that all work, images, words, and graphics must be original? These items can be used for educational and research purposes. If part of the work is used that meets the "Fair Use Act". It is better that teachers use part rather than all of the material. A person’s original work that is protected by law and therefore copyrighted. This work can include: literary, dramatic, musical, artistic or other intellectual property.
